Fulfilment time is counted from the moment payment is credited.
We carefully secure every Order before dispatch so that it arrives safely and as quickly as possible.
6.3. Transfer of responsibility for the shipment
a) Responsibility for the shipment passes to the Customer upon receipt (Art. 548 §3 of the Polish Civil Code). In the event of loss or damage to the shipment, the Seller will promptly refund the Customer’s payment or send a new Product.
b) For Customers who are not Consumers, risk passes to the Customer when the shipment is handed over to the carrier (Art. 548 §1 and Art. 544 of the Polish Civil Code). In the event of damage to the shipment, the Customer submits a claim directly to the carrier.
6.4. Inspection of the shipment upon receipt
We recommend inspecting the shipment upon receipt. If the shipment is damaged, the Consumer should prepare a damage report in the presence of the courier. Failure to prepare a report may make it harder to pursue claims against the carrier.
6.5. Delays and force majeure
The Store is not liable for delivery delays resulting from the carrier’s fault or force majeure, in particular logistics system failures, transport disruptions, natural disasters, or other events beyond the Seller’s control.
6.6. In-store collection
In-store collection at the Seller’s showroom in Kraków is available. Please contact us in advance to arrange a collection time.
7. Complaints
If the Product you receive is defective or not in conformity with the contract, as a Customer you have the full right to submit a complaint. We are liable for lack of conformity of the Product with the contract in accordance with the Polish Consumer Rights Act. For customers who are not Consumers, we are liable in accordance with the Polish Civil Code.
7.1. How to submit a complaint
-
Submit a complaint in one of the following ways:
- by email to froart@froart.com,
- in person at the showroom at ul. Gołębia 10 in Kraków.
-
Prepare the information needed to process the complaint:
- proof of purchase (receipt, payment confirmation, or invoice),
- Order number,
- description of the defect,
- information on what you expect: repair, replacement, price reduction, or withdrawal from the contract,
- photos of the defect (optional — may speed up processing).
-
Deliver the product using one of the following options:
- send it to: ul. Gołębia 10, 31-007 Kraków, Poland,
- bring it in person to the showroom: ul. Gołębia 10, 31-007 Kraków, Poland.
7.2. Your rights when goods are not in conformity with the contract
As a Consumer, you have the right to have the Product brought into conformity with the contract by:
- repair of the Product,
- replacement of the Product with a new one.
If bringing the Product into conformity in the form you choose is impossible or would require excessive cost, we may propose an alternative solution. After an unsuccessful reasonable period for bringing the Product into conformity, you may request a price reduction or withdrawal from the contract — in accordance with the Polish Consumer Rights Act.
7.3. Examples of defects subject to complaint
- physical defects: faulty clasps, stones falling out on their own (poor setting), cracks resulting from casting errors,
- lack of conformity with the contract: the product differs from what was ordered (e.g. different model, colour, or size).
7.4. How complaints are handled
If the remedy you choose to bring the product into conformity with the contract is:
- impossible, or
- would require excessive cost,
we may propose an alternative solution (e.g. repair instead of replacement, or vice versa).
We carry out repairs or replacements within a reasonable time after the complaint is submitted. The time required depends on the nature of the Product and the complexity of the repair.
All costs related to repair or replacement, including shipping costs, are borne by the Seller.
We process complaints within 14 days of receiving them. Failure to respond within that period means the complaint is deemed accepted to the extent and on the terms provided by law. We will inform you of our decision by email.
7.5. Liability for lack of conformity caused by the Customer
The Seller is not liable for lack of conformity with the contract that results exclusively from:
- natural wear, e.g. worn gilding or a darker surface,
- mechanical damage caused by pulling, crushing, or contact with hard objects,
- contact with chemicals, water, perfume, or detergents,
- improper use or maintenance inconsistent with the instructions in “How to care for your jewellery”.
7.6. Natural characteristics of Products that are not defects
Our jewellery is handmade using natural stones. This means that each Product may differ slightly from the pieces shown in photographs.
Natural stones may have characteristic features such as:
- inclusions (micro-cracks, air bubbles),
- differences in colour, saturation, or clarity,
- subtle differences in mineral structure and arrangement,
- minor differences resulting from handcrafting,
- differences in the colour of the Product resulting from screen settings, lighting, or individual material characteristics.
These features are natural properties of stones and handcrafting, not grounds for a complaint.
We process complaints in accordance with the Polish Consumer Rights Act of 30 May 2014 (conformity of goods with the contract) and — for customers who are not consumers — in accordance with the Polish Civil Code.
The rules described in this section apply to Consumers and entrepreneurs with consumer rights. For Customers making professional purchases, the Polish Civil Code applies.
8. Returns (right of withdrawal)
We want you to be satisfied with your purchase. However, if for any reason you wish to return a product, you will find the necessary information below.
As a Consumer or entrepreneur with consumer rights, you have the right to withdraw from a distance contract within 14 calendar days of receiving the Order without giving any reason. The legal basis is the Polish Consumer Rights Act of 30 May 2014.
Information on withdrawal from the contract and how to return a product is available on the Delivery and returns page.
8.1. Submitting a withdrawal statement
The primary electronic withdrawal function is our online withdrawal form on the Right of withdrawal page — no account or password required. The form asks for your full name, order number, whether you are returning the entire order or part of it, and your email. We confirm receipt of your statement by email with the date and content of your statement.
You can also submit a return request from order history in your customer panel — a return option appears next to eligible orders. Guests can open the panel with the email from checkout and a one-time code (no password).
You can access the form via the footer policies row and the button Submit withdrawal on every page of the Store.
Alternatively, you may submit a withdrawal statement within 14 days of receiving the shipment by emailing request@froart.pl with your order number and the Products covered by the withdrawal. Your message should include your identifying details and the date of the statement. After email submission, the Store promptly sends confirmation of receipt on a durable medium (email).
You may use the withdrawal statement template available on the Delivery and returns page. Using the template is optional.
8.2. How to return a product
- Prepare the shipment. If possible, include proof of purchase and return the Products with their packaging and tags. Lack of packaging or tags alone does not deprive you of the right of withdrawal. You may handle and inspect the product only to the extent necessary to establish its nature, characteristics, and functioning. If you submitted withdrawal by email — we encourage you to send a completed withdrawal statement template available on the Delivery and returns page. This is not mandatory but may speed up the refund process.
- Send the shipment to: ul. Gołębia 10, 31-007 Kraków, Poland. When you withdraw from your purchase, return shipping is free — we send return instructions (including a return label, if applicable) after your withdrawal is confirmed.
8.3. Refunds
We will reimburse you without undue delay and no later than 14 days from the day we receive your withdrawal statement. We may withhold reimbursement until we receive the returned Product or proof that you have sent it back, whichever occurs first.
- we refund the amount paid for the Product,
- we refund delivery costs in the amount of the cheapest delivery option offered by Froart,
- funds will be returned using the same payment method used when placing the order.
If the value of the product is diminished as a result of use beyond what is necessary to establish its nature, characteristics, and functioning, we may reduce the refund by an amount corresponding to that diminution (Art. 34(2) of the Polish Consumer Rights Act).
8.4. When is a return not available?
Under applicable law, the right of withdrawal does not apply in the case of:
- products made to the Customer’s individual specifications or clearly personalised (Art. 38(1)(3) of the Polish Consumer Rights Act),
- products modified at the Customer’s individual request after the contract is concluded, where the statutory exclusion applies (e.g. individual engraving, stone or metal change, bespoke design).
If you are unsure whether your product qualifies for return, contact us before sending it.
8.5. Important information
- You have 14 days from submitting the return to send back the Product.
- We do not accept cash-on-delivery shipments or shipments sent to parcel lockers, parcel machines, or other collection points.
- Exchange of a Product is possible only by returning the product and placing a new order.
- When you withdraw from the contract, return shipping is free (paid by Froart).
- We do not accept returns at the physical store.
- The right of withdrawal applies only to Consumers and entrepreneurs with consumer rights.

10. Personal data protection
